What Is Statutory Maintenance?

Begin with the property use and equipment list. Identify the duty holder and the relevant requirement for each system. Record the basis for the task, the competence needed and the evidence expected after completion.

Tell us what needs doing

A rented property and a workplace do not automatically have identical duties. Nor does every asset have a universal annual inspection requirement. Dates need a documented basis in the applicable requirement, assessment or specialist advice, rather than being copied from another building.

Keep maintenance and examination separate

Maintenance preserves or restores an item's condition. Inspection and examination assess it for a defined purpose. Some work can be coordinated during one attendance, but each required activity must remain identifiable.

For example, HSE's lifting-equipment guidance explains the role of thorough examination and the need for sufficiently independent and impartial assessment. Servicing is not a substitute for that examination. The distinction matters when selecting resources and reviewing documents.

HSE's work-equipment maintenance guidance also explains the need to maintain equipment and plan maintenance safely. A completed examination does not remove the need for appropriate upkeep between examinations.

Check the scope of the evidence

Read the actual report. Confirm the property, assets, date and activity covered, then check exclusions and recommendations. A document covering one system does not establish the position of equipment omitted from its scope.

If an area was inaccessible, record it as an unresolved coverage issue. Arrange the required access or further assessment and retain the link to the original report. Missing evidence needs investigation; it should not be silently treated as either a satisfactory result or proof that work was never done.

Turn findings into actions

Each finding needs an owner, priority and next step informed by the relevant technical requirement. Separate immediate controls from permanent repairs and record the evidence needed to close the action.

Administrative targets cannot extend a legal deadline or override necessary technical action. Keep the people authorising work informed of the actual finding and its consequence, rather than sending only a percentage-complete report.

Review the programme when equipment, use or responsibilities change. Retain current records and future dates during property or contractor handovers so requirements do not lose their owner.

Common questions

Does a maintenance contract transfer legal responsibility?

A contract allocates services and responsibilities, but it does not automatically transfer statutory duties. Identify the duty holders and the work assigned to each party explicitly.

Is a certificate enough to close a job?

Only when it provides the evidence required for that activity. Any findings, exclusions or recommendations need their own follow-up and closure records.

Who sets inspection intervals?

The applicable requirement and equipment-specific assessment establish the basis, with competent specialist input where needed. Record that basis and review it when circumstances change.
